These Terms and Conditions ("Terms") govern your use of the website www.downsrenos.com.au (the "Website") and any enquiry you make through it. By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

These Terms apply to your use of the Website. Any work we carry out for you is governed by our separate written quote and/or contract, together with your rights under the Australian Consumer Law and applicable building laws.

3. Using the Website

You may use the Website for lawful purposes and to learn about and enquire about our services. You must not:

• use the Website in any way that breaches any law or regulation;
• interfere with, damage or disrupt the Website or any servers or networks connected to it;

• use the Website to transmit any harmful code, or to send unsolicited or unauthorised communications; or

You may view and print content for your own personal, non-commercial use in connection with considering our services. You must not otherwise copy, reproduce, modify, distribute or commercially exploit any content without our prior written consent.

Images: Some images on the Website may be illustrative or representative examples used to show a style, finish or type of work, and may not be photographs of a specific completed job by Downs Renos. Where an image is a photograph of our own completed work, it is presented as such.

5. Enquiries, quotes and bookings

• Information on the Website (including any pricing guidance) is general in nature and does not constitute an offer or a binding quote.
• Submitting an enquiry or quote request through the Website does not create a contract. A contract for work is only formed once we have provided a written quote and you have accepted it, or we have both signed a written contract.
• Quotes are valid for 30 days from the date of issue unless we state otherwise in the quote. Quotes are based on the information available to us at the time and on the scope described. Additional or changed work ("variations") may affect the price and timing and will be agreed in writing.
• Where a written contract is required by law — including for domestic building work in Queensland above the relevant threshold — that contract will apply to the work and will prevail over these Terms to the extent of any inconsistency.

6. Our services and your consumer rights

We provide tiling, tile replacement, regrouting, resealing, waterproofing, leaking shower repairs, home maintenance and kitchen and bathroom renovation services, and related services as described in our quotes.

We carry out building work under QBCC licence number 15431509.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things:

• for services, you are entitled to have them performed with due care and skill, fit for the specified purpose, and within a reasonable time; and
• for major failures, you are entitled to a remedy such as a refund, and to compensation for reasonably foreseeable loss or damage.

Where the law applies, building work may also carry statutory warranties and insurance under the Queensland Building and Construction Commission Act 1991 and related building laws. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or those laws.

7. Pricing and payment

Pricing, deposits, progress payments and payment terms for any work will be set out in your written quote or contract. Unless stated otherwise, prices in a quote are inclusive of GST where GST applies. Deposits and payment schedules will comply with the limits set under Queensland building legislation where that legislation applies to the work.

8. Third-party links

The Website may contain links to third-party websites or resources. We provide these for convenience only and do not endorse and are not responsible for their content, products or practices. Accessing third-party websites is at your own risk and subject to their terms.

9. Disclaimers

The Website and its content are provided on an "as is" and "as available" basis for general information only. While we take care to keep information current and accurate, we do not warrant that the Website will be error-free, uninterrupted, secure, or that the information is complete or up to date.

Any reliance you place on Website content is at your own risk. For advice specific to your property or project, please contact us for a site assessment and written quote.

10. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded ("Non-excludable Rights").

To the extent permitted by law, and other than in respect of your Non-excludable Rights:

• we exclude all liability for any loss or damage (including indirect or consequential loss) arising out of or in connection with your use of, or inability to use, the Website; and
• where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of having them re-supplied.

To the extent permitted by law, you agree to indemnify us for any loss, damage, cost or expense we suffer arising from your breach of these Terms or your unlawful or negligent use of the Website.

These Terms are governed by the laws of the State of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
